Dalry man sentenced for assault at Glasgow Central station

Kamal Khan pleaded guilty to two charges when he appeared at Kilmarnock Sheriff Court in December.

The 33-year-old admitted attacking the woman and throwing an item, striking her on the body and seizing hold of the back of her neck at Glasgow Central on October 27 last year.

He also accepted that he shouted and swore at her, demanded she open a door, repeatedly kicked and struck it causing it to break, and forced entry to a room at a property in Largs.

The court heard how Khan, of Vennel Street in Dalry, and his now former partner went to Glasgow on the day of the incident.

A prosecutor told the court that Khan was speaking in an aggressive manner to the victim in the city centre station, berating her in front of her child, and he also grabbed her by the back of her neck.

He also shouted in the face of the woman, who had the youngster with her during the incident. A witness also heard an aggressive spit from the pair, although it was unclear where exactly it came from.

The court was told that the complainer remained fearful of Khan at the Largs address and was scared the situation would escalate.

She went to bath her child and locked the door, but Khan began screaming and shouting for her to open it, saying “I bet you’re in there phoning the police”.

She asked her friend by phone to call the police but before officers could arrive, Khan had kicked the door in and forced his way in to the bathroom, with neighbours hearing shouting.

The procurator fiscal depute said: “Officers arrived and traced the distressed woman, but there was no sign of the accused, who was arrested and charged at a later date.”

Khan’s defence solicitor told the court that his client had been in custody for more than 50 days at the time of the sentencing hearing.

He added: “This all began because of an allegation the complainer made of infidelity and that caused ill feeling.

“My client did take her momentarily by the back of the neck and barged her with his shoulder. He knows he shouldn’t have done that. The matter got out of control.

“He would be prepared to do unpaid work or be subject to a curfew. If he was to be placed on the Caledonian Men’s Programme, it would be in the public’s and his interest.”

Sheriff Morag Fraser said: “This involved a child who must have been quite terrified. [They were] in a house with a man kicking the bathroom door.

“There is no question that this meets the threshold for a further period of custody but that’s not going to solve anything.”

Khan was sentenced to a community payback order, which includes two years of supervision and two years on the Caledonian Men’s Programme.

He was also ordered to carry out 180 hours of unpaid work within 12 months.

The Caledonian Men’s Programme is a behaviour programme for men convicted of domestic abuse offences.
